These Terms of Service (these "Terms") govern your access to and use of cherryroot.com and any related services (collectively, the "Site"), operated by Glimmer of Luxury LLC ("CherryRoot," "we," "us," or "our"). By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site or place an order. We currently ship only to addresses within the 48 contiguous United States; by placing an order you confirm your shipping address is within our service area.
2. Your Account
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Please notify us immediately at info@cherryroot.com of any unauthorized use.
3. Products Are Not Medical Advice
The content on this Site, including product descriptions, articles, and any wellness information, is provided for general informational purposes only and is not intended as medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any new supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition.
4. FDA Disclaimer
Statements regarding our products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.
5. Orders, Pricing & Availability
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or unauthorized resale. If we cancel an order after payment has been taken, we will issue a full refund. Prices are shown at checkout and may change at any time, but changes will not affect orders already placed.
6. Subscriptions
If you choose "Subscribe & Save," your order will automatically repeat and your payment method will be charged at the frequency shown at checkout (currently every 4 weeks) until you cancel. You can pause, skip, modify, or cancel your subscription at any time before the next billing date through your account or by emailing info@cherryroot.com. 7. Text Message (SMS) Communications
If you opt in to receive SMS messages from us, message and data rates may apply and message frequency varies. You can opt out at any time by replying STOP. See our Mobile Messaging Terms for complete details.
8. Shipping & Risk of Loss
You are responsible for providing an accurate shipping address. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. See our Shipping Policy for details on delivery timing and lost or damaged packages.
9. Refunds
We offer a 90-day money-back guarantee as described in our Refund Policy, which is incorporated into these Terms by reference.
10. Resale Restriction
Our products are intended for personal use by the end consumer. You may not purchase our products for the purpose of resale, and we reserve the right to refuse or cancel orders we reasonably believe are intended for resale.
11. Intellectual Property
All content on the Site — including text, graphics, logos, and images — is owned by or licensed to us and is protected by copyright and trademark law. You may not copy, reproduce, or use our content without our prior written permission, except as necessary to use the Site for its intended personal, non-commercial purpose.
12. User Submissions
If you submit a product review, comment, or other content to us, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business, and you confirm the content is accurate and doesn't infringe anyone else's rights.
13. Prohibited Uses
You agree not to use the Site for any unlawful purpose, to attempt unauthorized access to our systems, to use automated means (bots, scrapers) to access the Site without our permission, or to interfere with the Site's normal operation.
14. Disclaimer of Warranties
The Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free.
15. Limitation of Liability
To the fullest extent permitted by law, CherryRoot and Glimmer of Luxury LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to your order will not exceed the amount you paid for the product(s) giving rise to the claim.
16. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
17. Dispute Resolution & Arbitration
Please read this section carefully — it affects your legal rights. You and CherryRoot agree to resolve any dispute arising out of or relating to these Terms or your use of the Site through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. You and CherryRoot each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@cherryroot.com with your name and order number and stating that you opt out of arbitration.
18. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where the arbitration agreement above requires application of the Federal Arbitration Act.
19. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page at least 30 days before they take effect. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
